A succession right is a person who has a right to become the tenant of record after the prior tenant of record either permanently leaves the apartment or dies. The law permits persons to claim succession rights as a traditional family member and non-traditional family member. Traditional family members include spouses, children, parents, stepchildren, stepparent, brothers, sisters, grandparents, parents-in-law, and children-in-law. However, aunts, uncles, nieces, nephews, and cousins are not included. All hope is not gone, a person that does not fall under this category may be considered as a non-traditional family member.
Non-traditional family members are occupants who have the same kind of family relationship as a traditional family without succession rights. The court will examine whether there is a strong financial and emotional interdependence to establish a family relationship. Some of the factors, include, but are not limited to the length of the relationship, shared household expenses, participation in family-type functions, such as holidays, vacations, or celebrations, to name a few.
