On December 28, 2020 Governor Andrew Cuomo signed the COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020. The Act provides assistance to tenants in landlord and tenant eviction cases. Several key provisions include staying pending residential proceedings and foreclosure for sixty days from December 28, 2020, permitting tenants, lawful occupants, or any other person(s) responsible for paying rent to submit a Hardship Declaration based on financial hardship due to the pandemic.


The Act also includes staying proceedings and actions, including evictions, until May 1, 2021 based upon the tenant’s submission of a Hardship Declaration Application. The tenant, however, may be determined ineligible for a stay should the Court find that the tenant engaged in persistent and unreasonable behavior that substantially affects the use and enjoyment of other tenants or occupants or causes a substantial safety hazard to others.
