Who Can Serve As Guardian?

Pursuant to Mental Hygiene Law § Section 81.02, a guardianship judge will determine whether the appointment of a guardian is necessary to provide for the personal and property needs of the person such as food, clothing, shelter, health care, to name a few.


Mental Hygiene Law § 81.03 (a) states that a guardian must be a person over 18 years or older. A guardian can also be a corporation, public agency, or local department of social services for a person’s personal and/or property management needs.
